SUBJECT:     Adoption Leave for Service Members Adopting Children

This message provides specific guidance to authorize the use of permissive temporary duty (PTDY) in accordance with Section 593 of Public Law 109-163, the National Defense Authorization Act of Fiscal Year 2006, as codified in Section 701 (i)(1) of Title 10 United States Code.  This section authorizes up to 21 days per calendar year of non-chargeable adoption leave for eligible service members adopting a child on or after 1 Jan 06.  Title 32 Guard are not authorized adoption leave unless federalized under Title 10 for more than 29 consecutive days.  Reserve members must also be on active duty for more than 29 consecutive days prior to taking adoption leaveThe following guidance is provided:

1.  Adoption leave may be authorized in conjunction with ordinary leave.

2.  In the event that two members of the Armed Forces who are married to each other adopt a child in a qualifying child adoption, only one of the members shall be granted an adoption leave of absence.

3.  A qualifying adoption is defined as the member being eligible for adoption reimbursement of qualified adoption expenses for example, adoption fees, and placement fees, legal and medical fees.  Members can refer to Section 1052, of Title 10 United States Code for more information.

Members will submit their request on an AF IMT 988 Leave Request/Authorization, indicating PTDY and use the statement Adoption Leave per HQ AFPC/DPS Memorandum dated 18 May 06 until the revised AFI is published with the new rule to Table 7.
